BCM GIFT CARD
General Terms and Conditions
(Effective 29th September 2017)
By using the BCM Gift Card, you are accepting the General Terms & Conditions set out below and will be bounded by them.
GLOSSARY
In this BCM Gift Card General Terms and Conditions, the following expressions shall have the following meanings unless the context otherwise requires:
1. “Bank” – means Banco Comercial de Macau, S.A., or its successors and assigns;
2. “Gift Card” – refers to a prepaid card pre-loaded with a designated value issued by the Bank from time to time under this General Terms and Conditions, including replacement cards;
3. “Cardholder” – means a person who has purchased, possessed or has made use of the Gift Card for transaction;
4. “Visa” – means Visa International;
5. “Merchant” – means any merchant authorized to accept a Gift Card on presentation by a Cardholder as a method of payment for goods or services through the Visa network;
6. “Prepaid Value” – means the designated amount pre-loaded into a Gift Card upon purchase by a Cardholder;
7. “Expiry Date” – means the expiry date of the Gift Card stated on the card face;
8. “Transaction” – means a payment instruction for goods or services originating from a POS machine and caused by the use of a Gift Card.
BCM Gift Card (“Gift Card”) is a prepaid card issued by Banco Comercial de Macau, S.A. (the “Bank”) which stores a pre-loaded value (“Prepaid Value”) and equipped with payment service and enquiry function provided by the Bank.
The use of the Gift Card signifies and constitutes the acceptance of and to be abided by the following terms and conditions:
1. USE OF CARD
1.1. Purchase and use of Gift Card is limited to persons aged 18 or above.
1.2. Gift Card is available for sale at all BCM Branches for the Bank’s customers only.
1.3. A Prepaid Value ranging from MOP100 to MOP3,000 has to be paid by the customer and pre-loaded to the Gift Card upon purchase. (The minimum and maximum amount of the Prepaid Value is to be determined and amended by the Bank from time to time.)
1.4. Any amount stored into the Gift Card will form the Prepaid Value of the Gift Card and cannot be reversed or reload.
1.5. The Gift Card is not transferable once it is signed by the Cardholder.
1.6. The Cardholder can use the Gift Card at any Visa acceptance merchants which accepts the Gift Card for effecting purchase of the goods and / or services. The Bank, however, shall not be responsible if the Card is not honored at any of the aforesaid merchants for any reason nor shall it be responsible in any way for the goods and / or services supplied by the merchants. Any complaint from the Cardholder against the merchant must be resolved by the two parties concerned and the existence of any claims or disputes between these two parties shall not constitute any responsibility to the Bank.
1.7. The Gift Card cannot be used in any local or overseas ATMs or for cash withdrawal, internet transactions, mail orders, telephone purchase orders, transactions on board of airplanes, cruises or effected at casinos, bill payments, Visa No-CVM (cardholder verification method) transactions, BCM Interest-Free Installment Plan, Cash-in Plan, “Easy-Fun” Installment Program as well as any other exclusions defined by the Bank or Visa from time to time.
1.8. When the Gift Card is used, the Cardholder shall sign on the sales slips with the signature identical to the specimen appearing on the Gift Card and the transaction amount will be deducted from the Prepaid Value automatically. Any variance in Cardholder’s signature will not relieve the Cardholder from any liability for the use of the Gift Card.
1.9. A non-refundable handling fee, to be defined by the Bank from time to time, will be charged separately from the loading amount upon purchase of the Gift Card.
1.10. Transactions made in currency(ies) other than the currency of the Gift Card shall at all times be charged to the Gift Card in their counter-value at the rate of exchange determined by the Bank or Visa at each moment.
1.11. Transaction effected in non-card currency region or non-card issuing region shall be charged a Cross Currency Fee and Cross Border Fee for the reimbursement charge levied by Visa. Such fees are to be deducted from the available balance along with the transaction amount.
1.12. Details of fees are set out in BCM Banking Service Charges Table. The latest version of the BCM Banking Service Charges Table is available at BCM Website at www.bcm.com.mo or at any BCM branch.
1.13. Under all circumstances, the Gift Card cannot be used upon expiry and the residual value shall not be refunded.
1.14. In case the Gift Card has insufficient available balance to pay for the total transaction amount including the service charge (if applicable), the Transaction will be declined automatically.
1.15. Enquiry on available balance can be accessed at BCM Website or by calling TeleBCM at 8796 8888, whilst enquiry on the Transaction records can be made through the latter.
1.16. Cardholder shall use the Gift Card for payment in a proper and legal manner. The Bank shall not be responsible for any and all consequences, if the transactions involving improper use of the Gift Card or the use of Gift Card are not honored or inoperative for any reason or if there is a malfunction and / or failure of the Terminal or network.
1.17. The Gift Card is anonymous and has a nature of cash. Cardholder shall keep the Gift Card secure at all times in manner to prevent someone else to use the Gift Card. Cardholder shall be fully responsible for transactions involving loss or theft of the Gift Card, improper use and the use of Gift Card by any person whosoever not authorized by the Cardholder. No replacement of Gift Card and refund of residual value will be allowed in the aforesaid events.
1.18. Replacement of Gift Card is only accepted in case of malfunction due to reasons other than the fault of the Cardholder provided that the defective Gift Card is within validity period. Cardholder shall apply replacement at BCM Branch and the unused balance will be transferred to the replacement card.
1.19. The Bank reserves the right to determine whether or not to issue any replacement and to charge any fee for the replacement.
1.20. The Bank may at any time terminate the Gift Card without prior notice or cause. Upon demand, the Cardholder shall unconditionally and without reservation immediately surrender or procure to surrender the Cards to the Bank.
2. MISCELLANEOUS
2.1 The Bank reserves the right to alter, add and / or delete these General Terms and Conditions from time to time and may notify the Cardholder of any such changes and the effective date in any manner it thinks fit. Retention or use of the Gift Card after the effective date will constitute acceptance of such changes without reservation by the Cardholder.
2.2 If any provision of this Agreement shall be held to be illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions hereof shall in no way be affected or impaired hereby.
2.3 In this Agreement, if the context permits or requires, words importing one gender shall include all other genders and words in singular number shall include plural number and vice versa. Headings are for reference only and will not affect construction of this General Terms and Conditions.
2.4 This Agreement is written in Chinese and English. In the event of any conflict interpretation, the Chinese version shall prevail.
2.5 This Agreement is governed by the Law in force in Macau and the parties concerned agree in submitting all the conflicts arising from the interpretation of this Agreement or in connection with the use of Gift Card to the non-exclusive jurisdiction of the Courts of Macau.
